Terms of Use

These are the terms you agree to by using Barcall. They are short on purpose. If something here is unclear, write to support@barcall.fit and ask — a term you did not understand is not a term worth having.
Barcall is published by Nikhil Kumar, Bhartiya City, Bangalore, Karnataka 560064, India ("we", "us"). "You" is whoever is using the app.
If the app is distributed through the App Store without these terms published at a URL of ours, Apple's standard End User Licence Agreement applies instead: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Nothing below is intended to give you less than that agreement does.
What Barcall is
Barcall builds a training plan and decides what load, sets and reps to put in front of you next, based on what you have logged. It does that on your phone.
What Barcall is not
It is not medical advice, and it is not a coach who can see you. It has never watched you lift, it does not know your injury history beyond the movements you told it to avoid, and it cannot tell whether today's number is a good idea for your body. Lifting weights carries a risk of injury. You train at your own risk, you are responsible for your own form and your own judgement, and you should speak to a doctor before starting a training programme — particularly if you are pregnant, recovering from injury or illness, or have a heart, joint or blood pressure condition.
If a prescribed load feels wrong, do not lift it. The app is designed for you to override every number it gives you, and doing so makes its next prescription better, not worse.
Your account
You do not need an account to use Barcall. Setup offers you one and you can skip it; everything the app does, it does on your phone. An account exists so your plan survives a new phone, and you can create one at any time from Settings.
If you do create one: you must give an accurate email address, you must be old enough to agree to these terms where you live (13, or the older age your own country sets for agreeing to this on your own — in India that age is 18), and you are responsible for keeping your password to yourself. Tell us at support@barcall.fit if you think someone else has got into your account.
You can delete your account at any time from Settings inside the app. It is immediate and it cannot be undone.
We can suspend or close an account that is being used to attack the service, to break the law, or to resell access.
The free tier and the paid tier
Barcall's free tier prescribes your first three sessions in full. After that it keeps working as a logbook forever: your plan stays, every movement demo stays, unlimited logging stays, your history stays. What stops is the part that decides what to do next — the prescribed loads, the reasoning behind them, and the analysis screens.
Nothing you have logged is ever deleted or held hostage because you did not subscribe.
Subscriptions and payment
Barcall is sold through the App Store. Three things are on offer:
Barcall Annual — an auto-renewing subscription, billed once a year.
Barcall Monthly — an auto-renewing subscription, billed once a month.
Barcall Lifetime — a one-off purchase. It is not a subscription and it never renews.
The exact prices are shown on the purchase screen in the app, in your own currency, and are the prices Apple charges — they are the authority, not any number written here.
How billing works. Payment is charged to your Apple ID when you confirm the purchase. A subscription renews automatically at the same price for the same period unless you cancel at least 24 hours before the current period ends. Your Apple ID is charged for the renewal within 24 hours of the end of the period.
Free trials. Where a free trial is offered, it converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends. The app schedules a reminder before that happens, and shows you the charge date before you start. If you buy a subscription during a free trial, the unused part of the trial is forfeited, as Apple requires.
Cancelling. Cancel from your device: Settings → your name → Subscriptions. Cancelling stops the next renewal; it does not refund the period you are in, and you keep access until that period ends. We cannot cancel a subscription on your behalf — only Apple and you can.
Refunds are handled by Apple, under Apple's terms, at https://support.apple.com/billing. We do not process payments and cannot issue refunds ourselves. If something has gone wrong, write to us anyway — we would rather know.
Restoring. If you reinstall or move to a new phone, "Restore purchases" on the paywall or in Settings signs your existing purchase back in. It never charges you again.
Price changes. If a subscription price changes, Apple will tell you and ask for your consent before charging the new price, in line with App Store rules.
What you may and may not do
You get a personal, non-transferable licence to use Barcall on devices you own or control, for your own training. The app, its exercise library, its media, and the prescription engine remain ours.
Please do not: resell or sublicense access, share an account with other people to avoid paying, reverse-engineer or decompile the app except where the law says you may, scrape the exercise library or plan data for another product, or use the app to break the law.
Your data
What we collect and where it goes is set out in the Privacy Policy: https://barcall.fit/privacy. The short version is that your training, your Health data and your progress photos stay on your phone, and we hold your email address and six setup answers.
Your training data is yours. Deleting it in Settings deletes it, including the copy in your own iCloud.
Availability, and changes to the app
We will try to keep the app working and improving, but we do not promise it will be available without interruption or free of bugs. Features can change or be removed; the app is provided "as is" and, to the extent the law allows, without warranties of any kind.
If a change removes something you paid for and we cannot give you an equivalent, contact us.
Liability
To the fullest extent permitted by law, we are not liable for injury, loss or damage arising from your use of the app, including any training decision made using it, beyond the amount you have paid us in the twelve months before the claim.
Nothing here limits liability that cannot legally be limited — including for death or personal injury caused by our negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you, and you may have consumer rights these terms cannot override.
Apple
Apple is not a party to these terms and has no obligation to provide support for the app. Apple is a third-party beneficiary of these terms and may enforce them against you. Any claim that the app fails to conform to a warranty is between you and us, not Apple, subject to Apple's own refund policy.
Changes to these terms
If these terms change, the date at the top changes and the new version is published here. Continuing to use the app after that means accepting the new version. If a change is significant and you have an active subscription, we will tell you before it takes effect.
Governing law
These terms are governed by the laws of India, and the courts there have jurisdiction, without affecting any consumer protection rights you have where you live.
Grievance redressal
If you have a complaint about how we have handled your personal data, write to support@barcall.fit with "Grievance" in the subject line. It reaches Nikhil Kumar, who answers it, and we will resolve it within 30 days. Indian data protection law asks you to raise it with us before taking it to the Data Protection Board of India.
